Historical Figures 20 Questions

Having worked through all the possibilities last night, I have narrowed the most likely down to two.

The first (and honestly, my second favourite Justice of them all):

Is it Associate Justice of the Supreme Court Oliver Wendell Holmes, Jr?

Holmes is far and away the greatest justice, in my opinion, though John Marshall was probably the most important simply because he was there at the beginning and shaped what the United States would become.  Among more modern (i.e., late 20th Century justices), Hugo Black is underrated.  Odd that both Holmes and Warren would make your list of favorites, as the latter's judicial philosophy was diametrically opposed to the former's -- Holmes was the champion of judicial restraint, and Warren was the champion of judicial activism (i.e., "we'll do whatever the fuck we want to because we're right and the rest of you are wrong").  Both are undeniably important in American history.

Next figure.

That's exactly why I love both of them.  Because they were diametrically opposed.  One has to wonder how Holmes would have found in Brown vs. Board of Education or Miranda v. Arizona; one wonders what might have happened if Warren had run the court of the 20s or 30s.  I believe Holmes was correct in his strict interpretation of the rights given, and I believe Warren was correct in that the Constitution covers rights as the future comes to understand them.

Ah, cool.  I'll be lacking in internet access for the next few days, so if there isn't one by monday, I'll try to come up with something....(I'm gonna be stuck with dial up for a while)
